Terms and conditions

Applicability of these terms
These general terms and conditions apply to all offers and quotations issued by Den Hartog B.V. (hereinafter “Den Hartog”), as well as to all agreements between Den Hartog B.V. and the client.

Delivery
Our prices are based on direct delivery to organisations. Much of our furniture is made to measure. The delivery time is 6 to 8 weeks unless agreed otherwise.

Prices
All prices are non-binding and exclude VAT unless stated otherwise. We reserve the right to change prices.

Payment
Payment must be made within 14 days of the invoice date by deposit or bank transfer to account NL83 ABNA 0579 3546 52 in the name of Den Hartog in Dronten. If the payment term is exceeded, we charge at least the statutory interest plus 2%. Payment must be made without deduction, set-off or suspension on account of an alleged or actual failure by Den Hartog B.V. Different payment terms apply to non-end users, including intermediaries, contractors and dealers: 30% upon order, 50% three days before delivery and 20% within 14 days after delivery. If the client fails to pay within the agreed term, the client is in default without notice of default being required. From the due date, Den Hartog B.V. is entitled to charge interest at two percentage points above the statutory commercial interest rate. If payment is not made, Den Hartog B.V. is entitled to suspend performance of the order immediately. In the event of late payment, the client must reimburse Den Hartog B.V. for all reasonably incurred judicial and extrajudicial collection costs, including collection agency fees and the actual fees and costs of bailiffs and lawyers, even if these exceed the legal costs awarded by a court. These costs are set at a minimum of 15% of the outstanding balance, subject to a minimum of €160.00.

Retention of title
Goods are delivered subject to retention of title. This means that the goods remain the property of Den Hartog B.V. until the invoice has been paid in full.

Packaging
Packaging is not charged unless it is charged to us by the carrier.

Claims
If damage is discovered upon delivery, the buyer must either refuse the shipment or report the damage immediately to the carrier that delivered the goods. If the number of packages does not match the consignment note, the buyer should sign only for the number of packages actually received. Complaints must be submitted to us in writing within 48 hours.

Returns
Returns can only be made after consultation with our internal sales department. Items must be returned in their original condition and packaging; otherwise we cannot accept them. Return shipping costs are at the customer’s expense. Furniture orders cannot be returned because furniture is not held in stock and is produced to order.

Furniture delivery costs
The stated prices include delivery to the ground floor. Delivery and installation of furniture on an upper floor are subject to a surcharge, which will be stated in our quotation. If the customer fails to inform us in advance that delivery must take place on an upper floor, an additional charge may be applied afterwards. Delivery may be impossible if no suitable lift is available and the furniture is too heavy to carry upstairs. Stated prices include delivery within mainland Netherlands. Different transport and delivery rates apply to the islands. Furniture orders under €1,250.00 excluding VAT are subject to a delivery charge of €59.00 excluding VAT. Transport costs to Belgium are always available on request; no carriage-paid order threshold applies.

Delivery costs for other materials
Orders with a value of €175.00 or more excluding VAT are delivered carriage paid. Orders under €175.00 excluding VAT are subject to a shipping charge of €12.50 excluding VAT. Orders outside the Netherlands but within the EU with a value of €275.00 or more excluding VAT are delivered carriage paid. Orders under €275.00 excluding VAT are subject to a shipping charge of €15.00 excluding VAT.

Orders
Orders can be placed by telephone, through the webshop or personally through a sales adviser.

Warranty and repairs
All items are supplied with a full one-year manufacturer’s warranty. After this period, repairs are carried out at the cost of materials, travel and the standard hourly rate.
